Can Your Spouse’s Divorce Lawyer Be Disqualified From Your Florida Divorce?

DivorceHeartRings

Even a Miami divorce that begins relatively simply can become complicated. Miami spouses may need to address property division, finances, parenting issues, support, and numerous court procedures. Sometimes, an issue that neither spouse could have anticipated can make the case even more complex.

A recent Florida appeals court decision provides an unusual example. In that divorce case, the judge presided over the case for approximately 16 months before retiring. A few months later, the former judge became a partner at the law firm representing the husband in the same divorce. The wife then asked the court to disqualify the husband’s law firm from the case.

While most Miami divorces will never involve circumstances like these, the case illustrates an important point: divorce proceedings can sometimes develop in ways Miami spouses never expected.

An Unexpected Issue Complicated the Florida Divorce

After the former judge joined the husband’s law firm, questions arose about whether the firm could continue representing the husband. The trial court initially allowed the firm to remain in the case. However, the wife appealed that decision, bringing another layer of litigation into an already ongoing divorce.

Florida’s Fifth District Court of Appeal determined that the law firm should have been disqualified. The court concluded that the former judge had personally and substantially participated in the divorce while serving as the judge and that his new firm had not satisfied the requirements necessary for the other lawyers at the firm to continue representing the husband.

Your Miami Divorce May Present Issues You Did Not Anticipate

The circumstances in this case were unusual, but complicated issues can arise in many different ways during a Miami divorce. For example, soon-to-be ex-spouses in Miami may disagree about whether property is marital or separate, how valuable assets should be divided, what should happen with the marital home, or how parenting and financial issues should be resolved. New disputes may also develop as the case moves forward.

The reality is that you may begin a divorce believing you know which issues need to be resolved, only to encounter additional legal questions later.

Why is Having a Miami Divorce Attorney on Your Side Important?

Trying to anticipate every issue that could arise during a Miami divorce can be difficult. You also may not know when an unexpected development has legal significance or requires action.

An experienced Miami divorce attorney can help you understand the issues already present in your case and respond when new ones arise. A Miami divorce attorney can also explain court procedures, evaluate how Florida law may apply to your circumstances, and advocate for your interests as the divorce moves forward.
