Disabled Miami Father Investigates Child Support Payments Taken Out of Disability Checks after Son Turns 18 – When Do Child Support Payments Stop under Florida Laws?
A disabled Miami-area father spoke with WSVN News 7 Miami about the child support payments that continued to come out of his Social Security Disability checks each month, even though his son had already turned 18 years old. Jonathan Salomone, a Miami-area father and Veteran of the armed services told the Miami news outlet that he and his now-adult son have a good relationship, noting that, “The limited time I get to see my son, we like going to the Everglades or go to the Keys, fishing.” However, things have not been exactly easy for Salamone, as he lost his job after being in the army and became disabled and then homeless. Now Salamone receives a Social Security check each month to survive. That check is only $1,500 per month.
In addition to going towards rent and living expenses, such as food and bills, Salamone’s Social Security checks were also, until very recently, going towards child support payments for his son. Out of the $1,500, the automatic payments of $300 for the child support leaves Salamone with only $1,200 per month to pay for living expenses. Of the child support payments, Salamone said, “So, I don’t mind the money going to my son, but now he’s working and soon he’s going to have a real profession.” Indeed, Salamone’s 18-year-old son is now working, leaving Salamone stumped as to why he was still required to pay child support.
Salamone turned to the news to figure out why he was still paying the child support payments, since his son was no longer a child. The experts at the news channel reasoned that, “If you owe back support, you have to pay the amount off. But in most cases, you don’t have to pay after the child turns 18. There are exceptions. If the child is still in high school, you have to pay until they graduate. If they have special needs, you may have to pay for life or you can ask your ex to stop paying support. It can not hurt to ask.” The news channel then contacted the Florida Department of Revenue, but hit a roadblock as the agency did not want to discuss the case with the news. Salamone himself spoke with the agency and finally got some answers, reporting back, “Basically, it’s done. The case is closed. They’re going to stop taking the payments from my Social Security.”
